The Parties
This agreement is between you or “THE USER” or “THE LICENSEE” and SmartObjects. SmartObjects is a registered Partnership in England and Wales. By downloading and installing the software you automatically agree and are bound under of jurisdiction and courts of England and Wales to the terms below.
General Terms
You acknowledge you have fully read and understood all terms within this agreement. This document supersedes any other agreement oral or written between SmartObjects and the licensee. No variation of this agreement will be accepted, other than an exception created by SmartObjects.
The SmartObjects represented by this contractual agreement are the intellectual property of SmartObjects and their respective creators.
If you wish to promote SmartObjects mockups on your site, you must link back to the SmartObjects resource page where users can find the download and not directly to the download file.
Unlimited Access
Members of SmartObjects are billed on a yearly schedule, but you may cancel your subscription at any time via your member account on SmartObjects. As soon as you cancel your subscription, you will continue to be able to download member-only resources up until you reach the end of your year subscription.
Our memberships are not to be shared with other users. If the membership was created by a company, only its direct employees can use the account on the behalf of the company.
A subscription to SmartObjects is non-refundable. If there has been an error on the users part then we will deal with refund requests on a case-by-case basis.

Rights
You are permitted to use SmartObjects mockups in any number of personal and commercial projects for yourself or a client. You may modify the mockups according to your requirements and include them into works such as websites, applications, printed materials and others.
Licence non-transferable
The licensee may NOT sell, lease, sublicense, or otherwise assign or transfer any rights, duties or obligations under this agreement, in whole or in part, to any person, or third-party. Any breach of this will result in immediate termination of the license agreement and you will be required to delete all copies, or destroy all materials (in any and every medium, digital or physical) that contain the breached license.
Upon full payment of the appropriate license received by SmartObjects, you become a licensed user NOT an owner of the SmartObjects. Purchased mock ups will remain, in whole, copyright to SmartObjects and their creators.
Breach of licence
Breach of any of these terms in case of gross negligence or unlawful misconduct will result in the termination of the contract immediately, and we will revoke the license for the purchased mock ups without refund. After termination, you must destroy all copies, including backup or archival copies on external medias.
Refunds
We do NOT give refunds, all sales are final, unless proven that the files are defective, after a period of exhaustive technical support and evaluation.
